Montolivo is alleged to have asked Pato to give him the ball, but the Brazilian opted to step up to the spot himself.
Pato subsequently missed the penalty when his effort comfortably cleared the bar in a game that the Viola won 3-1.
Montolivo left Fiorentina for Milan in the summer on a free transfer after his contract had expired in Tuscany.
